 Hello Everyone, I am back after a month in Tunza. I hope all of you are fine and doing your good works. For December we had topic of ¡®Country's environmental regulation or infrastructure¡¯. Here is my report on ¡®A brief highlight in Nepal¡¯s Environmental Law¡¯. Environment consists of all living and non-living things occurring naturally. Unplanned development in the urban area have led to problems like water pollution, solid waste, air pollution, noise pollution, etc. In Nepal, Kathmandu is the capital city and due to rapid increase in number of vehicles every year it has become the major concern to all. Due to this, rules for exhaust gases mainly due to vehicles are executed first within the valley. All over the world, there is an urgent requirement for protecting the environment. We must care it as it is degrading at an alarming rate. Here in Nepal many youth lead organisations are working restlessly for its preservation and creating awareness. In Nepal, The Environment Protection Act, 2076 (2019) has replaced the previous Environment Protection Act 2053(1997) which is thought to be more effective and sustainable. This was reformed to address the issue of climate change which was not the case in the previous regime during king¡¯s rule. The Regulating Authorities under the Act include the following authorities: 1. Government of Nepal; 2. Environmental Examiner; 3. Environment Protection Council; 4. Department of Environment and 5. Ministry of Forests and Environment The following decisions have been made and established by the Government of Nepal in order to combat the ever-growing pollution problem of the country: 1. Standard for inspection of used vehicles 2. Standard for import of vehicles 3. Compliance plans 4. Enforcement plans 5. Compensation plans The Act in its clause 7 describes, Prevention and Control of Pollution as, 1. Nobody shall create pollution that may cause significant adverse impacts on the environment or likely to be risky to public life and people's health, or dispose or cause to be disposed sound, heat radioactive rays and wastes from any mechanical devices, industrial enterprises, or other places contrary to the prescribed standards. 2. If it appears that anyone has carried out any act contrary to sub-section (1) and caused significant adverse impacts on the environment, the concerned agency may prescribe necessary terms in regard there to or may prohibit the carrying out of such an act. 3. If it appears that the use of any types of substance, fuel tools or device has caused or is likely to cause significant adverse impacts on the environment, the Ministry may, by a notification in the Nepal Gazette, forbid the use of such substance, fuel, tools or device. 4. Other provision relating to the prevention and control of pollution shall be as prescribed. This Act of pollution control is described as "Prohibition to emit waste in contravention of the prescribed standards: No person shall emit or cause the emission of noise, heat radioactive material and waste from any mechanical means, industrial establishment or any other place in contravention of the standards prescribed by the Ministry by notification published in the Gazette." (The acts was copied) Not only rules and acts be formed it should be implemented and followed. Its duty of everyone to protect and care about mother earth and act jointly for sustainability.
