International Environmental Law

by Anishka Jha | 18-08-2018 00:07 recommendations 0

International environment law are the decisions, treaties and collaborations with in the legal framework between nations across international boundaries in order to settle environmental disputes and concerns. The vastness of this area of international law includes the environmental sub-issues of population, biodiversity, global climate change, ozone depletion, preserving the Antarctic regions, movement of toxic and hazardous substances, land or vessel-based pollution, dumping, conservation of marine living resources, trans-boundary air and water pollution, desertification, and nuclear damage, among others.

To frame International environment laws, knowledge of treaty research and through awareness of the types of international agreements and the analysis of the nations which are the parties to the agreement and their environmental effect on other nations of the world as result of reservations, understandings, or declarations, are the mandatory requirements. Environmental laws keeps changing and expanding as per the geographical and structural regulation and implementation of the treaty terms are at the national level.

Truly effective environmental laws make sure, among other things, that companies design projects that cause the least amount of environmental harm and make the best use of resources. Laws also make sure these companies are the ones paying the costs of preventing or repairing damage to the environment, rather than downloading them to taxpayers as clean-up costs or healthcare expenses. In short, regulation forces companies to take care of the environment as part of the price of doing business. Environmental laws help ensure the environment and the economy are equally protected and promoted.

UAE plays a great role in abiding by International environment law. It has endorsed many ambitious projects and regulations by the International environment law agency. Environment Vision 2030 was developed to ensure integration among the three pillars of sustainability: environmental, economic and social vision. It aims to preserve and enhance UAE's natural heritage in the efficient use of resources and contributing to a better quality of life for all. UAE consider the impact of economic constraints on the environment, taking into account the social aspects as well as the over-use of natural resources. Uncontrolled development can also result in damage to the environment in terms of the release of toxic substances and hazardous waste. Thus, attention is paid to issues of development compatibility with environmental protection, particularly in cases of possible serious contamination and toxicity.

Hello Aniska, environmental laws are almost soft laws, not hard laws to enforce state parties to move up to public objectives and goals to reach its common point. Unfortunately, being passive in the middle of final process to pass the environmental treaty or law literally means that it would never be hard laws to bind us to reach public goals at the end.
    Thanks for your report!
