Eco laws in Kazakhstan |

One of the arguably most important eco laws is Article 288. Article 288 was amended by the laws of the Republic of Kazakhstan as of 03.12.2011. 1. Physical and legal persons, in the course of economic activity of which waste is generated, must provide for safe handling measures, comply with environmental and sanitary-epidemiological requirements and carry out measures for their utilization, processing, neutralization and safe disposal. 2. Waste placement and disposal shall be carried out in places determined by decisions of local executive bodies in coordination with the authorized body in the field of environmental protection and by the state body of the sanitary and epidemiological service and other specially authorized state bodies. 3. Waste storage sites are designed for the safe storage of waste within a period of not more than three years prior to their restoration or processing, or no more than one year before their disposal. 3-1. Temporary storage of waste is not waste disposal. The places of temporary storage of waste are designed for the safe collection of waste within a period of not more than six months prior to their transfer to third parties engaged in the disposal, processing, and disposal of waste that cannot be recycled or utilized. In case of violation of terms of temporary storage of production and consumption wastes (but not more than six months) established by the project documentation, such wastes are recognized as posted from the moment of their formation. 4. Import to the territory of the Republic of Kazakhstan from countries that are not members of the Eurasian Economic Union and export of waste products from the territory of the Republic of Kazakhstan to these countries for the purpose of their use (utilization, processing) are carried out on the basis of a license issued by a body authorized by the Government of the Republic of Kazakhstan. The import and export of waste by individuals for personal use (for non-commercial purposes) are prohibited. 5. In cases stipulated by this Code, the waste owner is obliged to develop a waste management program with a view to gradually reducing their volumes. 6. When choosing the method and place of disposal or disposal of waste, and also when determining the physical and legal persons carrying out the processing, disposal or disposal of waste, the owners of the waste must ensure minimum movement of waste from the source of their generation. 7. Import of disposable products may be restricted or completely prohibited if it leads to the formation of waste, the disposal of which is associated with high environmental risk or economically impractical. 8. It is prohibited to import products, resulting in the production of hazardous waste that does not have the technology to neutralize or dispose of them in the Republic of Kazakhstan. 9. Production and import of products are banned, resulting in the production of waste containing persistent organic pollutants as provided for by international treaties of the Republic of Kazakhstan on persistent organic pollutants. These rules are not always followed, but the government is taking steps to closer supervision and harsher consequences. |

The Eco law stated in your report is truely outstanding, very practical and easy to understand. Such laws are also in other member states as it is good to know that the country of Kazakhstan is following suite!

Hello Ayazhan
The 5th mentioning that 'the waste owner is obliged to develop a waste management program with a view to gradually reducing their volumes.' is important that it points out the importance of where to set the responsibility. It would also be possible to have a standardized waste managing system that can actually optimize methods and do the job for waste owners but to actually oblige waste owners to use this system as a mandatory.

Thank you for keeping us updated.Point 5 and 6 should also be adopted by developing countries as the citizens here are not accountable thus they bravely fulfill their wishes at the cost of polluting environment
