THEMATIC REPORT: ENVIRONMENTAL LAW OF NEPAL

Hello everyone!!

Its has been bit I have not been active in reading articles and reports here in Tunza due to tight schedule of final examination and practical exams. I apologise for being inactive in those days. In December, we had topic of ¡®Country's environmental regulation or infrastructure¡¯ as a thematic report. Here I have presented a brief about ¡®The Implementation of International Environmental Law in Nepal¡¯. All the information presented hereby is extracted from internet and the references taken is presented at the end of the report. 

The summarized overview of environmental law enforces in 1997 are The 1969 Vienna Convention on the Law of Treaties should be ratified by Nepal as soon as possible, All relevant legislation in Nepal should be reviewed in detail in order to ensure that the treaties to which Nepal has become a party, or shortly intends to become a party, include adequate provisions for the implementation of those treaties, The Nepal Environmental Policy and Action Plan should be implemented by the government forthwith. 


Talking about ¡®Environmental Protection Act, 2076 (2019), it was enforced and effective implementation was done in on July 19th, 2019 as for the result Environment Protection Act, 2053 (1997) (the ¡°1997, Act¡±) was dissolved.   The salient feature of the newly enacted law was it was compulsory of several compliances to Project Developers while developing a Proposal of a Project, to confirm if the implementation of the project has caused harm or adverse effect to the environment in any way. This act has given the precise and understandable definitions of the terminology related to the environment. ¡°Pollution¡± has been redefined so as to include waste, chemical, heat, sound, electronic, electronic magnet or radioactive radiation that significantly degrade, damage the environment or harm the beneficial or useful purpose of the environment by changing the environment directly or indirectly.

The Regulating Authorities under the Act which consists the following authorities:

a) Government of Nepal;

b) Environmental Examiner;

c) Environment Protection Council;

d) Department of Environment and

e) Ministry of Forests and Environment

 Environmental Study Report should be prepared before the starting of the proposal, depending on the Proposal, and includes the following:

a.       Summary Environmental Study

b.      Initial Environment Examination

c.       Environmental Impact Assessment

Among other things the Act assign responsibility to the Government of Nepal to: 

a) Stop any Proposal in contravention to the Act.

b) Control and regulate Pollution in the country.

c) Initiate plans to protect the environment.

d) Prepare a yearly report on subject matter including the change in the quality of air and water.

    Warm greetings from Korea!
    Thank you for sharing about Nepal's environmental laws.
    I wonder how much size projects are subject to regulation.
    In Korea environmental impact assessments are conducted by high-rise buildings, tunnels, and underground roads.
    Efforts should be made to minimize environmental hazards before building or developing a place.
    If the environment is seriously damaged, it is very difficult to revert back, so I think we should approach it carefully.
    I'll look forward to your next report.

    Thank you for sharing your thematic report regarding environmental law of Nepal.
    It is nice that we can share current actions in different countries,
    thereby providing opportunities to others to improve environmental situations having a reference.
    I like that the Act enforced and highlighted issues of pollution.
    South Korea is stressing the importance of reducing pollution too, and we have related aims and newly enacted regulations as well.
    It is fine that you get information from external sources, but it would be great if you can add your own comments or thoughts related to the topic.
