International Environmental laws, their violation and possible solutions

Environmental laws are the regulations to bind the humans in controlling their actions on the nature and the environment. It describes the common network of treaties, regulations, morales, customary laws and regulations all kept forward to address the human impact on environment. Many environmental laws are guided by some principles and key identifying key concepts. Though not universally recognized but still the key concepts of sustainable development, equity, public participation, transparency, precautionary principles and polluter pays principles are always integrated in their makings to ensure fair enforcement.

But the human nature has always tried to violate any kind of laws and regulations. Some many times such righteous laws are also violated.  Many cases of violation or unfulfillment of famous environmental regulations like Kyoto Protocol has already been seen. The cases of violation of the Clean Water Act by the West Verginia Oil and Gas Company during the drilling of natural gases  by dumping pollutants into water falls, caused them to be fined $600,000. The Deepwater Horizon oil spill of 2010 was a catastrophic environmental distaste for the United States, resulting in widespread pollution throughout the entire Gulf of Mexico region. The case of Patridge vs. Crittenden in 1968, Carter vs. Carter Coal Company in 1936, The trafigura Case, 2009, etc are some of the major cases of environmental violations.

Though there are such many examples of violation of international environmental laws, still the proper judgment to the guilty in not done. Many of the multinational co-operatives are easily getting with their crimes against the environment just by paying some amount of cash. Is this enough for the crimes against nature?. If this continuous, then the feeling of regret will never be developed among this people.

So, in my opinion only the formation of the laws can never be enough. There must be some kind of provision to ensure that people don?t walk away from the crimes to nature just by paying some handsome amount of money. Instead of that, they should be made to undo the damage done by them, which can be done by re-cleaning of the polluted water, afforestation in the deforested area, running community awareness program and similar others. The guilty should be able to realize their mistake and not repeat again.

    Hello Prayash, there are always flaws and errors in 'any' integrated or united groups. As you mentioned in your report, paying some money or fine is not just 'enough' for individual countries in charge of degrading or not devoting or not being responsible for environmental problems.
    As you may know already, environment itself cannot be calculated or transmitted in the field of economic cost or price. Though there are some vague concepts or social norms such as environmental tax, carbon dioxide trade or so, it is still fact that human beings cannot fully compensate or change what we haves used so far with other artificial stuffs.
    There must be additional and delicate rules restricting such immoral and irresponsible activities in the international environment regime.

    'the formation of the laws can never be enough.' seems to penetrate the core of the problem that we are facing. Although IELs are made to conserve the environment still some do walk away from its regulation by money. To make sure that the laws function rightly, there should be provisions, just as the report suggests!

    It's great to know that those that violated the laws and regulations under the IEL were punished harshly for their act against environment (the West Virginia Oil and Gas Company).
    But, what you say it very true, that basic justice on those that committed such horrendous crimes have ceased to reflect the damage that they have done on the ecosystem at large.

    Not everything can be fixed with money and that is the main problem that our states fail to see.

    As you have typed, the formations of laws are just not enough...and that is what needs to be stressed to the governing leaders of unions and states in order to shift their behavioral mindset.
